Patent Attorneys in Israel-Advocates

Patent and intellectual property attorneys are fully qualified lawyers. Sometimes lawyers who deal with patents are called patent lawyers, but they have received certification from the Israeli Bar Association, as received by all attorneys in Israel who specialize in various different fields.

Our Team is Comprised of Lawyers, and Lawyers who are also Patent Attorneys

Patent attorneys can also work in the field of patents, designs, trademarks, and some other areas of intellectual property law, but they mainly deal with registration and other proceedings in the Patent Authority. Patent lawyers also deal with intellectual property and patents, and work with proceedings with the Patent Authority, mainly in Patent Court, but they also can represent a client during proceedings where a patent attorney is not authorized to do so, such as proceedings taking place in court.
For example, if there has been a breach or violation of a patent, design, trademark, or copyright, injunctions and claims for compensation due to violation can only be claimed in court.

Section 155 of Patents Law notes,
“A patent attorney shall, by the Court's permission, have the right to plead in Court on behalf of a party to proceedings under this Law on any matter that relates to an invention or a patent and is not a point of Law, on condition that the advocate of that party is present at the time.”

In other words, in Israel, only a lawyer can argue and represent a legal point in court. However, patent attorneys can also represent a client this is only possible with permission of the court (if it is granted) by claiming that the matter relates to an invention or patent on condition that the party’s legal representative is present at that time.

Moreover, lawyers can accompany the inventor and the company through the commercial aspect, with negotiations and preparation of various documents, preparing warning letters to be sent to intellectual property right violators, and other powers that the law does not authorize patent attorneys.
